Regulatory Approval with SIRIM, MITI & Suruhanjaya Tenaga (ST)



  • 1.SELF-LABELLING PROGRAM (SLP)
  • What is SLP?

    SLP is a Self-Labelling Program for certified communication products whereby Certificate Holder or Principal/Manufacturer self-label their certified products according to MCMC’s Guideline on Certification Mark for Self-Labelling (SL) and SIRIM QAS International procedures.

    SL is a certification mark that carry information of the certified product and shall be associated with certificate holder, manufacturer and principal, which are the same with the ones submitted for Type Approval.

  • Is SLP a new labelling program?

    Yes, it is a new programme. SLP has replaced the conventional  SIRIM labelling program (normal label  & SIRIM Label Forecast Program (SLFP)).

  • What labelling method can be used for self-labelling?

    There are two methods :-

    1. e-Labelling - E-labelling is certification mark in electronic form. The electronic certification mark is supported by firmware or operating system (OS) which can be displayed, stored and retrieved from the product but cannot be erased.

    or

    1. Surface-Labelling.  – As for Surface-Labelling, the certification mark is either engraved or embossed or printed or any method of marking which is deemed suitable with the nature of the product.
  • What kind of Certification Mark must be used for SLP?

    The certification mark for SLP shall consist of two components, the MCMC logo and the unique ID.

    The unique ID shall be either Common ID (CID) or Certificate Holder ID (HID) that will be assigned upon SLP ID Application. Below is the sample of the SLP Certification Mark:

  • What is Common ID (CID)?

    The common ID is assigned to the Principle/Manufacturer who executes and produces its own Self-Label.

  • What is Certificate ID (HID)?

    Certificate Holder ID is the ID assigned to the certificate holder that execute and produce its own Self-Label.

  • Who will apply and hold responsible for SLP?

    All certificate Holders are eligible to apply for SLP and it is the obligation of the Certificate Holder to ensure that all certified products bear a valid SLP Certification Mark.

  • 2.TYPE APPROVAL/SPECIAL APPROVAL/IMPORT PERMIT
  • What is the meaning of SIRIM Type Approval?

    Type Approval is granted to a controlled product that meets a minimum set of regulatory, technical and safety requirements. Generally, type approval is required before a product is allowed to be sold in a particular country.  The appointed agency to grant this approval in Malaysia is SIRIM QAS INTERNATIONAL SDN BHD.

  • What is the meaning of SIRIM Special Approval?

    It is the approval done for any communication products that are supposed to be type approved but excluded from being type approved. It is meant for limited purposes, such as for research and development (R&D), demonstration, exhibition, training, trial, market survey and personal or company usage purposes. The special approval is subject for few terms and conditions. It is limited to 3 to 5 units of quantities per shipment, depends on SIRIM approval. The approval is granted through import permit and can be used solely for that particular shipment only.

  • I would like to import Handphone from China and please explain to me what are the procedures and how can you help me with it.

    For your information, handphone is a controlled item by Malaysian government. If you plan to import it for commercial purpose, you MUST have SIRIM Type approval before any importation can be done. We will need technical specs of the said handphone before we advise you further on the procedure and SIRIM approval cost. If you import only for personal purpose, we can advise you to apply under special approval only.

  • What are the allowed frequency for WiFi technology in Malaysia?

    Allowed frequencies for WiFi technology in Malaysia are as below:

    •802.11 b/g/n – 2400 ~ 2500 MHz

    •802.11 a/n – 5150 ~ 5350 MHz ; 5725 ~ 5850 MHz

  • What do we need to do if our WiFi product consist of un-allowed frequency 5.45 – 5.75 GHz?

    If your product consist of un-allowed frequency you are required to inform and instruct your manufacturer to disable the said frequency from your equipment prior any importation into Malaysia and during Type Approval application you will need to get a letter from the related manufacturer to support and as a proof that you have totally disabled the said frequency.

  • 3.DAGANG NET REGISTRATION
  • Why should I register for E-Permit Dagang Net account?

    E-Permit Dagang Net account is used for applying e-permit and it is compulsory for all local importers/exporters to register the account before they are allowed to apply for import/export permit.

  • How long it takes for registration? My shipment already stuck at customs

    Normally it takes within 7 to 10 working days after submission of complete Dagang Net registration documents from the applicant. It is a one time registration process only.

  • Is it compulsory to have DagangNet acccout?

    Yes, it is compulsory for local companies (the importers or exporters) who want to import/export goods into/from Malaysia, especially when the goods are subject for import/export permit.  Otherwise, no import/export permit can be applied and no shipment clearance can be done by Custom Malaysia.

  • What are Form 9, Form 24, Form 49 for registration of Dagang Net account?

    These are the company registration forms to proof that any particular company is a legal company, registered in Malaysia. These forms can be obtained from the Company Secretary of the registered company.

  • How can I get the import permit (e-permit) without Dagang Net account?

    Import/export permit (e-permit) is not allowed to be applied without valid account with Dagang Net. Effective 1st January 2012, all local importers are compulsory to have Dagang Net account as a pre-requisite before they applying any E-Permit.

  • How can I register the E-Permit Dagang Net account? Can you help me with this registration?

  • What is Dagang Net?

    Dagang Net is an established e-commerce service provider in Malaysia authorized by most Malaysian government agencies like SIRIM, Custom Malaysia, MITI, etc. for import and export permit online processing (e-permit) and other related online business solutions in Malaysia.   • Who should sign the Dagang Net registration form and agreement?

    Director, manager or any management level, authorised by the company.

  • 4.STRATEGIC TRADE ACT (STA)
  • What is Strategic Trade Act (STA)

    Strategic Trade Act 2010* [Act 708] (“the Act”), which came into effect on 1 January 2011 is the legislation that controls the export, trans-shipment, transit and brokering of strategic items, including arms and related material, as well as activities that will or may facilitate the design, development, production and delivery of weapons of mass destruction. This Act is consistent with Malaysia’s national security and international obligations.

  • Why we should have the Act?

    In 2004, the United Nations Security Council passed a Resolution, which requested member countries to establish an export control system for the purpose of non-proliferation of weapons of mass destruction. As a member country, we are requested to control exports of strategic products, which may be used for terrorist activities. Based on this Act, export permit is mandatory to be applied before exporting any strategic goods from Malaysia.

  • What is export permit? Why should I apply export permit?

    Export permit is the mandatory permit required for any strategic goods exported from Malaysia. It is an obligation for the exporter as stated in the STA 2010 Act. Otherwise, the exporters are subject to penalty of imprisonment and / or death sentence.

  • What kinds of products that are considered as strategic items/goods?

    Strategic items refer to goods and technology that are controlled under the STA 2010 Act. A definitive and comprehensive list of strategic items are prescribed in the Strategic Trade (Strategic Items) Order 2010. The Order reflects the items currently required to be controlled under the global export control regimes as well as the relevant United Nations Security Council Resolutions. The items are categorized as follows:

    Category ML : Military items

    Category 0 : Nuclear materials,facilities and equipment;

    Category 1 : Special materials and related equipment;

    Category 2 : Materials processing;

    Category 3 : Electronics;

    Category 4 : Computers;

    Category 5 : Telecommunications and information security;

    Category 6 : Sensors and lasers;

    Category 7 : Navigation and avionics;

    Category 8 : Marine; and

    Category 9 : Aerospace and propulsion

  • Products that require Import permit have its Harmonized Tariff System Nomenclature (HTS) to classify it. Does export permit using HTS code too?

    No it isn’t. Export permit has ECCN code instead of HTS code. Customs will use ECCN to determine whether the products are subject to export permit or not.

  • What is ECCN code?

    ECCN stands for Export Control Classification Number. An ECCN is an alpha-numeric classification used in the Strategic Items List to identify items for export control purposes and to determine the relevant authority involved in issuing the export permit.

    All ECCN have 5 characters, for example, 1A002, 4D003, or 9E102. There are 11 categories on the Strategic Items List (refer question 4). The first number of the ECCN identifies the category to which it belongs, for example, 1 = Special materials and related equipment, 4 = Computers, or 9 = Aerospace and Propulsion.

  • What is ECCN code?

  • Where can I get my products ECCN code?

    You can request the ECCN code from the product's manufacturer.

  • What is the lead-time in to obtain the export permit?

    Estimated lead-time is after 5 working days from the submission date (provided that all necessary documents are complete).

  • How many types of export permit available and which type is suitable for my company?

    There are 4 types of export permit; single-use permit, bulk permit, multiple-use permit, and special permit. When selecting these types of permit, you need to identify your business needs and activities that are more suitable for you. The following is the description of each permit:

    •Single-use permit – is a one-off export permit and issued on a shipment basis.

    •Bulk permit – is a multiple shipment export permit destined for one single country / destination.

    •Multiple-use permit – is a multiple shipment export permit destined for multiple countries / destinations.

    •Special permit – is a one-off export permit to export to a restricted end-user and issued on a shipment basis.

  • What is the validity period for the export permits?

    a)Single-use permit - 6 months

    b)Bulk permit - 2 years

    c)Multiple-use permit - 2 years

    d)Special permit - 1 year

     

  • Is the procedure in getting bulk and multiple permit same with the single use permit?

    No it is not. For bulk and multiple permit, your company must have Internal Compliance Program (ICP) first before authority can granted you the approval to proceed with Multiple permit.

  • What is ICP and can AnsarComp help us to get the ICP?

    ICP is an Internal Compliance Program which the definition would be like the below. We at AnsarComp, can advise and assist you to obtain the ICP from the very beginning until the end of the job process.

    (i)A set of internal procedures implemented within the company that ensures transactions satisfy the export control regulations of Malaysia. An ICP is a prerequisite for companies that wish to avail themselves of bulk and multiple-use permits under the STA.

    (ii)A commitment taken voluntarily to support the authorities by ensuring that internal controls and procedures are in place that safeguards a company from being taken advantage of by proliferators of weapons of mass destruction.

    (iii)The commitment to the ICP is satisfied when the company has established procedures in place to ensure that thorough investigations of the buyer and the end-user had been undertaken prior to shipment and export of strategic items and/or technology.

    The Key Elements of an ICP:

    (a) A written statement of intent on export controls;

    (b) A designated officer appointed at the level of management to oversee the implementation of the ICP and his/their responsibilities and positions stated clearly in the company;

    (c) Clear compliance policy and procedures prepared on the company‘s letterhead;

    (d) Transparent reporting and decision-making responsibilities for exports;

    (e) Knowledge of customer and the end-use of the items exported;

    (f) Centralised processing for the export of strategic item;

    (g) Early warning and screening of all enquiries and orders; and

    (h) Proper documentations of all transactions of strategic items to be kept for a period of at least six years.

    (iv)An ICP Guide and Checklist on the required documents to be submitted is as in www.miti.gov.my > STA 2010 > Internal Compliance Program. Submission of the documents to the Secretariat should be submitted manually with a letter on the company‘s letterhead and signed by the designated person in charge of export control.

    (v)The Secretariat will undertake pre and post audits for ICP compliance. These audits may be done without prior notice.

  • Is there any country or person that being restricted prior export?

    Yes, there are restrictions that have been gazetted by the government. The lists can be found at MITI website.

  • What is COR?

    COR is Certificate of Registration to Manufacture/Import issued by Energy Commission (ST) to manufacturer and importer prior to they apply for COA.

  • How to apply COR?

    Registration can be made through e-DIK system.

  • What are document require to apply COR?
    • Form D (Business Details)
    • Form 9
    • Form 44
    • Form 49 OR Form of Annual Return of a Company (latest)
    • Form 24
    • Warehouse Agreement (for rental only).
  • How long COR Validity?
    • Minimum 2 years and not more than 5 years.
  • Is COR a new process ?
    • YES, it is  a new process and  start implementing  in 2016.
  • Is COR compulsory?

    YES, it is compulsory to all manufacturers or importer prior to apply for COA failing which NO COA application can be done.

  • What is COA?

    COA is an acronym for Certificate of Approval, issued by Energy Commission (ST) to ensure that the manufacture, import, display, sale or advertise of:

    (a)any domestic equipment or

    (b)any equipment which is usually sold direct to the general public or

    (c)any equipment which does not require special skills in its operation

    under sub regulation 97(1) of the Electricity Regulations 1994 and other related requirements therein, meets the specified safety requirements and efficient use of electricity.

  • Who should apply for the COA?

    Manufacturers, Importers (shall be Malaysian company registered with the Companies Commission of Malaysia), Exhibitors, Sellers and Advertisers should apply for the COA.

  • Who should concerned with this COA procedure?

    The one should concern are:

    a)Consumer

    In line with the safety requirements as well as to safeguard the consumer’s interest and to ensure the efficient use of electricity, consumers should only purchase approved electrical equipment that have met the specified safety requirements and must be affix by SIRIM label.

    b)Manufacturers, importers, exhibitors, sellers, and advertiser

    must ensure that their obligations under the said Regulations are fulfilled

  • What types of products are subject to apply for COA?

  • What are the procedure or process to get the COA?

    To apply for COA :-

    1. Your company must register COR through e-DIK system .
    2. You must have DagangNet account with ST module.
    3. After both registration are complete, applicant will apply for the COA online
    4. At the same time, applicant must submit the approved and valid CB test report, datasheet/technical specification, and instruction manual together with processing fee of RM 30.00.
    5. After the application has been approved, annual fee amounting to RM 220.00/ RM320.00 need to be paid to ST for the COA to be issued.

  • What is the lead-time to get the COA?

    The lead-time is 14 working days from submission date.

  • I buy this product from manufacturer from China and want to sell in Malaysia under my company brand; can I use the same test report produce by manufacturer?

    Yes, you can apply COA for OEM product, but you need to submit the application with declaration letter from manufacturer indicating the model of their brand/trademark is the same with your company brand/trademark (the OEM product) and is using the same valid and approved CB test report like the original one.

  • I have three products to sell in Malaysia that subject for COA. They are from the same product category but with different models. Can I apply the COA by only one application?

    You can apply the three products from the same category under one application of COA, provided all the 3 models are using and sharing the same CB test report. Otherwise, you need to apply 3 separate COA applications.

  • Do we need to renew the COA?

    Yes, renewal of a COA shall be made within 2 months but not less than 14 working days from its expiry date.

  • How long the duration expiry date of the COA?

    The duration of the COA is one year from the approval date.

  • What is the procedure to renew the COA?

    Renewal of COA is being made through e-Permit system within 2 months (but not less than 14 working days) from its expiry date through e-Permit system. No processing fee will be charged by ST. Any COA renewal before the 2 months period or after 14 days from its expiry date, will be automatically rejected by the e-permit system.

    No COA renewal after expiry date or less than 14 days from expiry date. After the expiry date, it is subject for new fresh application of COA and all the   processing and registration fees will be charged.

  • My electrical product is not included in the controlled item/ non-regulated item, but the ST Officer had asked our company to apply for a Release Letter. How I am going to apply the Release Letter? Do we still need to apply the SIRIM Label?

    The Release letter application is still required to be applied through the e-Permit system. However you do not need to apply the SIRIM label as the item is non-controlled item.

  • Do you provide service for applying ST and SIRIM Label application for LCD TV?

  • For LCD TV, is it mandatory to apply both ST's and SIRIM's approval?

    Yes it is mandatory to apply for Certificate Of Approval (COA) from ST for LCD TV, because it is one of the controlled items, if you plan to import and market your products in Malaysia. Once it is certifified from ST, you will need to apply safety SIRIM labels for the said product.

  • What is the procedure of ST approval?

    The procedure to apply COA approval from ST as follows:

    1)The application must be under the local registered company in Malaysia

    2)Must provide complete technical spec / product datasheet / product brochure.

    3)Must provide valid test report for CB Scheme with Standard IEC 60065 (International Standard) or MS IEC 60065 (Malaysian Standard)

  • Do we need to attach any label or logo on packing?

    Yes, it is a mandatory to stick SIRIM safety label on the units itself. That is to prove that, the product has been successfully approved and tested by SIRIM and ST, and safe to use. Prior to purchase the SIRIM safety label, you must go through SIRIM product testing and etc. This procedure also takes sometimes before any purchasing can be made.

  • May I know approximately when we can get the final COA?

    Normally, the leadtime for application and approval process takes about 14 working days from the submission date. The complete process will take  with original certificate COA issuance is in 3 weeks from the submission date.

  • 6.MAQIS
  • What is MAQIS ?

    MAQIS is an acronym for Malaysian Quarantine & Inspection Services.

    It was established under Ministry of Agriculture and Agro-Based Industry Malaysia as a department to provide integrated services relating to quarantine and certification for the import and export of plants, animals, carcasses, fish, agricultural produce, soils and microorganism and include inspection of and enforcement relating to food and for matters related to it.

  • How to apply import permit for items that require MAQIS approval before can proceed for customs clearance?
