Effective January 2023, all manufacturers and importers of non-medical face masks must apply for MS SIRIM certification & labeling from SIRIM QAS International Sdn Bhd.
The Ministry of Domestic Trade and Consumer Affairs (KPDNHEP) in a statement said it was following the gazetting of the Trade Descriptions (Certification and Marketing) of Non-Medical Face Masks Order 2022 under the Trade Descriptions Act 2011, on April 5, 2022.
According to KPDNHEP, the gazetting aims to ensure that non-medical face masks produced either locally or imported comply with the safety standards set through the order.
The main reason for this implementation is to ensure that locally produced/imported non-medical face masks comply with safety standards as well as to resolve the issue of dumping poor-quality non-medical face masks in the Malaysian market also is to safeguard the well-being of the people & protect the interests of consumers.
FAILURE TO COMPLY
Companies
- Can be fined up to RM200,000
- For the 2nd/subsequent offense, a fine not exceeding RM500,000
Individuals
- Can be fined up to RM100,000/imprisonment not exceeding 3 years/both
- For the 2nd/subsequent offense, a fine not exceeding RM250,000/5 years maximum imprisonment/both
